Smoke and Carbon Monoxide Alarms Regulations 2022

Following our 2022 so far – what is happening in the private rented sector blog earlier in the year the  Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 apply from the 1st October 2022. The new regulations require that: –

  • All rooms with a fixed combustion appliance (excluding gas cookers) must contain a Carbon Monoxide alarm.
  • All smoke and carbon monoxide alarms to be tested and working before a tenancy begins.
  • Landlords to repair or replace any alarm which is faulty as soon as reasonably practicable once they have been informed.

There are a few other points to keep in mind: –

  • Mains operated smoke alarms should be replaced at least every 10 years or sooner as the manufacturer recommends. There is usually a label on units stating the expiry date so Landlords should keep a record of this and diarise to replace units as required.
  • Battery operated smoke and carbon monoxide alarms often have a shorter shelf life. Again look for the expiry date on the individual units and make a record of when they should be replaced.
  • Landlords should consider visiting properties periodically through the tenancy to test all alarms or arrange for a contractor to do this if they self-manage.
  • The Regulations are silent on oil fired appliances but oil-fired boilers emit harmful fumes. We recommend Landlords fit a battery-operated carbon monoxide alarm as a minimum.
  • Non-compliance with the 2022 regulations can lead to a fine of up to £5,000.

We recommend that Landlords: –  

  • Install and repair smoke and especially carbon monoxide alarms in their rented properties asap if they have not already done so.
  • Check alarms regularly thereafter.
  • Keep a record of expiry dates, testing and replacements.
